This Terms of Use is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of mylawyers.in (“Website”).

For the purpose of these Terms of Use, wherever the context so requires “You” or “User” shall mean any natural or legal person including without limitation any company, firm, sole proprietorship or other associations of individuals, who visit, search and assesses our Website for availing Our Services (defined herein below). For the purpose of these Terms of Use, wherever the context so requires “Lawyer(s)” shall mean an advocate entered in roll of advocates in accordance with Advocate Act, 1961 including without limitation advocates who have consented for their particulars to be included in “List of Lawyers”. You understand and agree that this List of Lawyers is just an index of Lawyers and is not a communication or advertisement to influence the User, for selection of any Lawyer. It is the sole discretion of the Users to avail or not to avail services from any Lawyer. .The term “We”, “Us”, “Our”, “MyLawyers”, “Company” shall mean MyLawyers These Terms of Use including without limitation the applicable policies which are incorporated herein by reference and which forms an integral part of these Terms of Use; govern Your usage of the Website. By accessing or using Our Website or availing Our Services, You signify that You have read, understood, and agree to be bound by these Terms of Use (“Agreement”)

The following terms and conditions constitute an agreement between you and MyLawyers. (“Mylawyers.in,” “we,” or “us”), the operator Mylawyers.in (the “Website”). BY USING THE WEBSITE, AND/OR BY REGISTERING WITH US, YOU SIGNIFY THAT YOU AGREE TO THESE TERMS OF USE, including that you consent to the information practices disclosed in our Privacy Policy, which is incorporated herein by reference, and that you are agree to comply with applicable laws, governed and interpreted by the country (hereinafter referred to as “India”). MyLawyers.in at its sole discretion reserves the right to make unilateral modifications to this Agreement without providing any notice or assigning any reason to You. Your continued usage of website after any such changes constitutes your acceptance of the changes made to this Agreement. If You do not agree with any terms of this Agreement, We encourage You not to accept this Agreement, stop Your use of the website and thereupon You shall not be permitted to access Our website.

Mylawyers.in is no way, directly or indirectly responsible for the advice and assistance provided by the Lawyers and Legal Professionals & Law firms. We are an independent 3rd party enablers who have built a platform where the clients can communicate with, and if the need be, meet the Lawyers.

Mylawyers.in has no control over the Services provided by the Lawyers and Legal Professionals & Law firms and will not be responsible in case of any issues/discrepancies with the Services provided by the Advocates, Lawyers and Legal Professionals & Law firms. Mylawyers.in has full rights to publish the free advice provided to their clients on their portal and in any external communication for public knowledge sharing. However, in none of the published content the user details will be displayed. In case you wish any of your questions and their respective answers ‘not’ to be published, please use any of the other services’ options i.e. Paid Email Support, Telephonic Assistance, Meet Advocates, Lawyers and Legal Professionals & Law firms and / or Video call Consultation.

Mylawyers.in has multiple Lawyers and Legal Professionals & Law firms for the same service vertical / sub vertical categories and there might be instances wherein a similar question has been answered in two different ways by the Lawyer(s). Mylawyers.in takes no liability towards these different opinions and answers of the Lawyers and encourages you to take another opinion from ‘your’ Lawyer / alternately decide which opinion to go ahead with based on merits and logical conclusions.

All of the materials and information on the web website are provided for informational purposes only, and may not reflect current legal developments or variances in the law of different jurisdictions. The materials and information on the Website do not necessarily reflect the opinions of the Lawyers of the Law Firms, their partners, clients or affiliates. The information in the Website is not guaranteed to be correct, complete or up to date. The mere receipt of an e-mail from or a “post” on the Website does not create a Lawyer-client relationship. The applicable Lawyer / Law Firm is solely responsible for providing its services to you, and you agree that Mylawyers.in shall not be liable for any damages or costs of any type arising out of or in any way connected with your use of such services (including, without limitation, claims based on malpractice). You agree that any claim arising out of your relationship with a Law Firm or Lawyer shall be brought solely against such Law Firm or Lawyer, and, as Mylawyers.in is doing nothing more than assisting the Law Firms to enable their respective practices, neither Mylawyers.in nor any of its licensors or affiliates shall be included within any such claim.

Whenever we use the words “your Lawyer” or “your Professional” or “service provider” or similar words on Mylawyers.in, including in these Terms of Use, we mean your personal Lawyer / professional with whom you have of an actual, mutually acknowledged, Lawyer-client relationship (or the same kind of formal, real-world relationship between you and your personal professional service provider). Mylawyers.in Lawyers are not “your” Lawyers / professionals or service provider.

Mylawyers.in, Lawyers / Professionals using Mylawyers.in to provide online consultations (collectively “Lawyers”), Affiliates and Third-party providers (collectively “Affiliates”) would serve you to the best our ability under the following terms and conditions:

Using the Mylawyers.in website

This is a contract between You and MyLawyers.in. You must read and agree to the terms and conditions of this Agreement before using the Services. If You do not agree to the terms of this Agreement, You may not use the Services and end your use of the Website. You may use the Services only if you can form a binding contract with MyLawyers.in, and only in compliance with this Agreement and all applicable local, state, national, and rules and regulations.

Use of the Service provided by Us is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. If You are a minor i.e. under the age of 18 years, You shall not register as a User of the MyLawyers.in and shall not transact on or use the Service provided by Us. .. We reserve the right to terminate a User’s access to the Website if it is brought to MyLawyers.in notice or if it is discovered that You are under the age of 18 years or not eligible to enter into contract. .

The User takes full responsibility for ensuring that the information submitted is accurate. Mylawyers.in shall make no effort to validate any information provided by the Consumer for use in Services with respect to content, correctness or usability. We with an intention to provide the best service possible could ask you to share more information as and when needed.

Use of Mylawyers.in Services requires basic familiarity with the Internet, related payment services and general security practices. The Consumer is expected to possess the necessary internet-usage skills and knowledge to avail Mylawyers.in Services.

Freedom to Express of Lawyers & Law Firms

The opinions, statements, answers (collectively “consultation”) provided by the Lawyers via Mylawyers.in are solely the individual and independent opinions and statements of such individuals and do not reflect the opinions of Mylawyers.in, its affiliates or any other organizations or institutions to which such Lawyer or such specialist or professional is affiliated or provides services. Mylawyers.in does not recommend or endorse any specific tests, Lawyers, products, procedures, opinions, or other information that may be mentioned on Mylawyers.in or by a licensee of Mylawyers.in.

The inclusion of professionals and specialists on Mylawyers.in or in any professional directory on Mylawyers.in does not imply recommendation or endorsement of such professional nor is such information intended as a tool for verifying the credentials, qualifications, or abilities of any professional contained therein. Such information is provided on an “as-is” basis and Mylawyers.in disclaims all warranties, either express or implied, including but not limited to the implied warranties of merchantability and fitness for particular purpose.

No listing of any Lawyer on this website, and no information of any kind or answers provided by any Lawyer, constitutes an endorsement, recommendation or referral of any Lawyer. Lawyers do not provide any compensation or make any payment to Mylawyers.in in order to become Lawyer of Mylawyers.in or in order to answer any questions by Users on Mylawyers.in.

In connection with their participation on Mylawyers.in, Lawyers do make certain representations and warranties regarding the information they provide about the jurisdictions in which they are licensed to practice their profession and in good standing. Nevertheless, you are encouraged to investigate or perform your own due diligence concerning the Lawyers and their qualifications. No representation is made that the quality of the professional services to be performed is greater than the quality of professional services performed by other Lawyers. Terms of Membership with MyLawyers.in

You represent and warrant that you are at least eighteen years of age and that you possess the legal right and the ability to enter into agreements pertaining to Terms of Use, to register on the Mylawyers.in Services under your own name and to use the Mylawyers.in Services in accordance with the Terms of Use and abide by the obligations hereunder.

You are solely responsible for maintaining the confidentiality of your password and for all activities carried out under your Mylawyers.in account. You agree to prohibit anyone else from using your password and immediately notify Mylawyers.in of any unauthorized use of your password or other security concerns. No party has the power or authority as agent, employee or in any other capacity to represent, act for, bind or otherwise create or assume any obligation on behalf of the other party for any purpose whatsoever.

International members acknowledge and agree that Mylawyers.in may collect and use your Information and disclose it to other entities outside your resident jurisdiction. In addition, such Information may be stored on servers located outside your resident jurisdiction. By providing us with your Information, you acknowledge that you consent to the transfer of such Information outside your resident jurisdiction as detailed in our Privacy Policy. If you do not consent to such transfer, you may not use our Content or Services.

Your affirmative act of using this Website and/or registering for the Website or the Services constitutes your electronic signature to these Terms of Use and your consent to enter into agreements with us electronically. The Website may only be used in good faith and may not be used to transmit or otherwise make available any information that is false or that you do not have a right to make available under any law or under contractual relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements), to threaten, abuse, harass, or invade the rights of any person or entity, to infringe on any person or entity’s intellectual property rights, or in any other way that could reasonably be deemed unethical, illegal, or offensive.

You may not misidentify yourself or impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity (e.g., pretend to be a different person or from a different company or organization). Unless you have our prior written consent, you will not post advertisements or promotional materials, solicit participants and/or visitors of the Website, reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Website or its Services, use of the Website or it Services, or access to the Website or its Services.

You are prohibited from using any type of computer ‘worm,’ ‘virus’ or any other device that is intended or is likely to disrupt, overload, or otherwise impair the workings of any part of the Website. If you do engage in such conduct, the resulting damage will be hard to quantify as a fixed amount and thus you hereby agree to pay us liquidated damages in the amount of INR Rs.1,25,000/- for each day that the Website is damaged until the Website is completely repaired and further unquantified damages which will occur due to your act will be accessed and you shall be liable to pay the same. This amount is derived by estimating the value of (1) the loss of good will caused by an inoperable website, (2) the time and money it will take to repair the Website and to address the concerns of visitors. We are required to use reasonable efforts to repair the Website as quickly as possible. This clause will not prohibit us from seeking additional compensation if your conduct injures us in a way not expressly contemplated herein.

You are not permitted to collect or store personal data about other users.

You are not permitted to access the Website for the purpose of data mining or extracting content from the Website beyond your personal end use.

You are permitted to use the website to find a Lawyer to perform services for you related to your problem and to obtain general information about similar cases (each, a “Permissible Use”). You are not permitted to use the Website for any other reason other than a Permissible Use as described above. Impermissible Uses shall include, but are not limited to, using the Website to order to solicit, hire, engage or otherwise work with the employees or affiliates of Mylawyers.in or the Lawyers, to interfere or attempt to interfere in the relationship between Mylawyers.in and such employees, affiliates, Lawyers, or for any other purpose other than described herein (each, an “Impermissible Use”). If you do engage in such conduct, the resulting damage will be hard to quantify as a fixed amount and thus you hereby agree to pay us liquidated damages in the amount of Rs.2,00,000 for each Impermissible Use, and further unquantified damages which will occur due to your act will be accessed and you shall be liable to pay the same. You further agree that this liquidated damages provision reasonably approximates actual costs, losses, and expenses which would be incurred by Mylawyers.in due to any such Impermissible Use. You also agree that nothing in this section is intended to limit Mylawyers.in’s right to obtain injunctive and other relief as may be appropriate.

You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Website.

You agree to not harm minors in any way.

In the event you submit information through the Website, you agree to provide true, accurate, current and complete information and agree to promptly update the information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, and/or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your participation in the Website and/or refuse any and all current or future use of the Website or its services (or any portion thereof).

You hereby agree that, by taking any of the actions described above, you are soliciting and requesting a contact by telephone and as such, you may be contacted by telephone or e-mail as set forth in this Agreement and in our Privacy Policy, notwithstanding the listing of your telephone number and/or e-mail address in any applicable do-not-call registries.

User’s Profile with Mylawyers.in

Your Mylawyers.in Profile is created to store record of your consultations and your personal query / problem information online, including history, etc.Any information provided as part of a web, over-phone or an in-person / video consultation becomes part of your Mylawyers.in Record. You agree to provide accurate information to help us serve you best to our knowledge, to periodically review such information and to update such information as and when necessary.

Mylawyers.in reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Mylawyers.in Service according to its internal record retention and/or destruction policies.You might be contacted via email to review the information provided by you for Mylawyers.in Record or for Online Consultations. Please make sure you provide a valid email-id and you update it as and when needed.

Extent of Services

Mylawyers.in (the owners and the employee staff of the website) and third-party professionals who offer services through this website accept no responsibility for any medical, legal or financial events or outcomes related to services achieved through the use of the Website.

Mylawyers.in does not guarantee that a web-based consultation, over-phone consultation or in-person / video consultation is the appropriate course of treatment / solution for your particular problem.

Supplementary Communication

You will not otherwise attempt to transfer any right in the Services (which includes its software, design and content), create derivative works based on it or in any manner commercially exploit the Services in whole or in part. You agree that violations by you, any other person or entity, of these trade secrets and / or other intellectual property protections or the terms of this Agreement will be lead to prosecution under the Indian Laws and Bylaws. The final choice of whether the Consumer is in violation of any of these policies is at the sole discretion of Mylawyers.in.

Only for the duration of being logged into the Consumers’ valid Mylawyers.in account, the consumer is hereby granted a revocable, non-exclusive, non-transferable license to use the services for personal, non-commercial purposes; subject to terms and qualifications of Agreements of Mylawyers.in. With the exception of your case records, Mylawyers.in retains all rights, titles and interests pertaining to Mylawyers.in, the Mylawyers.in Services and any content, products, documentation, software or other materials on the Mylawyers.in web website along with any trade secret, trademark, service mark or other intellectual property or proprietary right in any of the foregoing.

Mylawyers.in welcomes comments, suggestions and submissions by its Consumers including but not limited to messages, notes, feedback, artwork, communications, computer code or creative materials provided to Mylawyers.in The act of commenting, suggesting or submitting shall act as a full assignment of all rights whatsoever (Intellectual property) to Mylawyers.in. Except as expressly provided herein, no other right or license with respect to any trademark rights or other proprietary rights are granted under this agreement. All rights not expressly granted hereunder by Mylawyers.in are expressly reserved to Mylawyers.in and its licensors and information and content providers. Contact us if you believe information on our website infringes your copyright. If you believe any materials accessible on or from Mylawyers.in infringe your copyright, you may request removal of those materials.

No part of the materials including graphics or logos, available in this Website may be copied, photocopied, reproduced, translated or reduced to any electronic medium or machine-readable form, in whole or in part, without specific permission.

Your license to access and use the Website and its services are subject to the following additional restrictions and prohibitions on use. The resources of Mylawyers.in should not be used to impersonate another person or misrepresent authorization to act on behalf of others or Mylawyers.in. All messages transmitted via Mylawyers.in should correctly identify the sender. The Consumer should never alter the attribution of origin in electronic mail messages or while posting any information.

Mylawyers.in has zero-tolerance for unsolicited bulk email, unsolicited posting to news groups, marketing gimmicks/spam/scams in community resources, or other illegal activities. The Consumer shall not infringe upon the rights of others, spam, propagate computer worms or viruses, use a false identity, attempt to gain unauthorized entry to any website or network, infringe trademarks, or other intellectual property rights. The Consumer further agrees to comply with Indian export laws concerning the transmission of technical data and other regulated materials via the World Wide Web.

The Consumer agrees to indemnify and hold Mylawyers.in harmless for any and all acts found or suspected to be in violation hereof. The Consumer’s account will be terminated for any of the above infractions. The Consumer shall not attempt to undermine the security or integrity of computing systems or networks of Mylawyers.in, its partners, or those accessed through or with their product, and must not attempt to gain unauthorized access.

Mylawyers.in does its best to protect your privacy with respect to information not otherwise disclosed by you in questions submitted to Mylawyers.in. In connection with the submission of Free Questions and Paid Consultations, we only require, and we encourage you to only provide, the minimum amount of personal identifying information necessary to process a question. All of your personal information provided to Mylawyers.in, including email addresses, is concealed from all other Users of Mylawyers.in and is never published as part of the Mylawyers.in public database. Only the Mylawyers.in administrators have access, for purposes of website administration only, to this information. Mylawyers.in will not disclose this information to third parties without your permission, except in the following circumstances: (i) to protect ourselves from liability, or (ii) to respond to legal process or to otherwise comply with the law. With respect to certain information supplied by you, as explained further below, there will be a need for disclosure to Lawyers / Professionals when you have booked a paid consultation.

Whether other information submitted to Mylawyers.in by you, such as the contents of the Question itself, will be publicly disclosed will vary as between Free Questions and Paid Consultations:

Free Questions & Answers. After a Free Question is answered, the Free Question and its answer are automatically posted to the Mylawyers.in public database. The contents of these Free Questions and their answers are visible to all Users of Mylawyers.in and to Lawyers / Professionals. Thus, Free Questions and answers to them are neither confidential nor privileged in any way. Although the contents of the Free Questions and their Answers are visible, the names and identifying information of the User who submitted the Free Question will not be visible to all Users of Mylawyers.in and Lawyers / Professionals. Of course, you must understand that, because the Mylawyers.in Answers public database is public, you may lose some privacy by posting Free Questions and their corresponding answers. Your view of the facts, or the way you frame a question, may well reveal something about your thinking about a problem that you may not want others to know. It’s your choice.

Mylawyers.in reserves the right to terminate any account which doesn’t follow our Terms and Conditions.

Suspension due to non-compliance with Agreement

Mylawyers.in will make all possible efforts to provide you the best services for your payment. However, Mylawyers.in shall not incur any liability and shall declare any service guarantee void in event of one or more of the following circumstances:

If you have not provided accurate details including contact information (user’s email and/or phone number), username and Payment account information.
If the transaction for payment doesn’t go through with your bank due to (including but not limited) insufficient funds, fraudulent access, failure of processing the request by our Affiliate merchants or your bank.
If circumstances beyond the control of Mylawyers.in (such as, but not limited to, fire, flood, or interference from external forces) prevent proper execution of the transaction.

Jurisdiction

Any dispute with Mylawyers.in shall exclusively be subject to the jurisdiction of the appropriate Courts situated at Chennai, India. All online bank transfers from valid bank accounts are processed using the gateway provided by the respective issuing bank which support payment facility to provide these services to the Users. All such online bank transfers on payment facility are also governed by the terms and conditions agreed to between User and the respective issuing bank. In the event User is not satisfied with the opinion he/she/it has received, the User can proceed to consulting a new lawyer through MyLawyers.in but a fresh payment of Service Fee shall have to be made for the same. MyLawyers.in has no liability to refund the money so paid for a consultation if the User is not satisfied by the legal advice provided by a Lawyer selected by the User.

Refund and Cancellation. The User may cancel their account or any requests at any time; however, Users are not entitled to any refund for cancellation. We may provide refunds only at our sole discretion. In the event we suspend or terminate your account or this Agreement, you understand and agree that you shall receive no refund or exchange for any Services availed, any content or data associated with your account, or for anything else, except at our sole discretion, we may provide you a refund or exchange.

Payment Information; Taxes. All information that you provide in connection with transaction or other monetary transaction interaction with the Services must be accurate, complete, and current. You agree to pay all charges incurred by you of your credit card, debit card, or other payment method used in connection with any transaction or other monetary transaction interaction with the Services at the prices in effect when such charges are incurred.
